This article analyzes which factors influence student performance in distance education degree courses at public and private higher education institutions. The foundations of the Educational Production Function Theory (EPF) and the establishment of the Open University of Brazil (UAB) as a public educational policy will underpin the methodology and discussions. The approach is quantitative, with microdata from the National Student Performance Exam (ENADE) and the multiple linear regression of Ordinary Least Squares (OLS) was used as the analysis technique for the empirical tests. Higher average performance was found for public HEIs in distance learning, as well as the significance of factors already consolidated in the literature related to students' academic performance. The results are relevant as they contribute to the design of the distance learning system in the country, as well as contributions of social interest, as they provide subsidies for more effective public educational policies.
